The small town of Midway, Kentucky appears destined to enact a smoking ban in the near future, as on Monday night the Midway City Council gave the first reading to a proposal that prohibit smoking in all public places and places of employment within city limits. During the meeting, the original ordinance (which can be read here) was amended to make the fourth violation by a business owner punishable by a fine of $500 instead of $1000. According to the Midway Messenger, city attorney Phil Moloney requested the change to keep the fine in line with those prescribed by the current language regarding misdemeanors. In addition, a proposed enforcement board was also removed from the ordinance. The ordinance does provide an exemption for private clubs without employees, as well as certain outdoor places of employment. If the ordinance is passed, those found to be in violation of it would face a fine of $50, while the owner of a business would face fines starting at $100 for the first violation, then escalating to $250 for a second violation in a calendar year and $500 for subsequent violations.
